Notarial acts

The notary is responsible for the proper conduct of the real estate purchase / sale process and for carrying out these activities in a manner consistent with applicable law. A notary's duty is, inter alia, ensuring that all documents relevant to the case (contracts, credit documents, etc.) are properly drawn up and have legal force. The processes related to real estate purchase / sale transactions involve a number of complex formal and legal activities.

Thanks to us, the entire transaction is conducted quickly and efficiently. This is because it is our responsibility to complete all formalities. A notary's office will take care of the legal side of finalizing the transaction - the notary will ensure that no regulations are violated and that the notarial activities are carried out efficiently. A notary's office and notaries we cooperate with suggest proven solutions that ensure the success of each case.

All services provided by a Notary are performed stationary - in the office, however, it is possible to carry out notarial activities in a place other than a notary's office - only in the event of justified circumstances.

In the interest of efficient handling of matters, below we publish a list of documents that are necessary to complete basic notarial activities.

Land donation and sale of the plot:

  • number of the land and mortgage register or an ordinary copy from the land register,
  • the basis for the purchase of the plot, i.e. an excerpt of a notarial deed of sale or donation agreement or a legally binding court decision confirming the acquisition of an inheritance,
  • personal data of buyers and sellers, recipients (names, surname, parents' names, marital status, ID or passport number, PESEL number, address of permanent residence, , NIP -tax identification number, company name, company seat),
  • situational map, required for legal purposes,
  • an excerpt from the land register along with an excerpt from the cadastral map,
  • an excerpt from the local spatial development plan on the intended use of the land or a certificate of its absence or a final decision on development conditions,
  • confirmation of payment of property tax,
  • a final decision that confirms the division of the property.

Sale of premises with a land and mortgage register or its donation:

  • number of the land and mortgage register or an ordinary copy from the land register,
  • the basis for the purchase of the plot, i.e. an excerpt of a notarial deed of sale or donation agreement or a legally binding court decision confirming the acquisition of an inheritance,
  • personal data of buyers and sellers, recipients (names, surname, parents' names, marital status, ID or passport number, PESEL number, address of permanent residence, , NIP-tax identification number, company name, company seat),
  • confirmation of payment of property tax and the fee for perpetual usufruct of land,
  • certificate that no one is registered for permanent or temporary residence in the premises,
  • certificate of no debt in the payment of maintenance fees/service charges

The establishment of the power of attorney for selling the property:

  • number of the land and mortgage register or an ordinary copy from the land register,
  • personal data of the principal (first names, surname, parents' names, marital status, ID card or passport number, PESEL number, address of permanent residence, NIP- tax identification number, company name, company seat),
  • personal data of the plenipotentiary/proxy/ representative (first and last names, parents' names, marital status, ID card or passport number, PESEL number, address of permanent residence, NIP- tax identification number, company name, company seat)..

Cooperative member's ownership right to premises-sale:

  • a certificate issued by a housing cooperative confirming the legal title to the premises,
  • land and mortgage register number (if the land and mortgage register has been established),
  • in the case of establishing a land and mortgage register - a certificate from a housing cooperative stating that there are no obstacles to its establishment,
  • an excerpt from the land register in the case of establishing a land and mortgage register,
  • a certificate confirming that no one is registered for permanent or temporary residence in the premises,
  • certificate of no debt in the payment of service charges.
